At Challenges, Inc. ("Challenges," "We" are used interchangeably), we take privacy matters very seriously. This Privacy Policy outlines what information we collect from you when you use the mobile, online and downloadable products and services (collectively, "Services") offered by Challenges and its subsidiaries, and how we treat that information.
WHEN YOU USE THE SERVICES, YOU CONSENT TO THE COLLECTION, STORAGE, TRANSFER, DISCLOSURE, MANIPULATION AND OTHER USES OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. PLEASE READ IT CAREFULLY.
1. Collecting Information
We collect the content and other information you provide when you use our Services, including your username, password and email address when you sign up for an account, or your Facebook login/profile info when you sign up with Facebook.
We also collect your profile information that you provide for your user profile (e.g., first and last name, picture, email, phone number, if any). This information allows us to help you or others be "found" on our Services.
We also collect your user content (e.g., photos, videos, comments, challenges you create and challenges you participate in and other materials) that you post to the Services. This can include information in or about the content you provide, such as the location of a photo/video or the date/time a file, challenge, or a trophy was created.
We also collect Information you provide to enter a contest/trophy challenges, or sweepstakes. If you win, we may need to collect your social security number, postal address and/or national identification for eligibility, prizes delivery and tax purposes.
We also collect information about how you use our Services, such as the types of content you view or engage with, or the frequency and duration of your activities.
We also collect information from or about the computers, phones, or other devices where you install or access our Services, to the extent of the permissions you've granted us. Such device information can be, but not limited to: operating system, hardware version, device settings, file and software names and types, battery and signal strength, device identifiers and locations, connection information such as the name of your mobile operator or ISP, browser type, language and time zone, IP address.
We also collect certain log file information when you use our Service, including your web request, Internet Protocol ("IP") address, browser type, referring/exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information.
2. Using Information
We may use information that we receive to:
- efficiently help you to access your information by remembering your login information so you will not have to re-enter it on your next visit to our Services;
- provide personalized content and information to you and others, which could include online ads or other forms of marketing;
- improve, test, and monitor the effectiveness of our Services;
- diagnose or fix technology problems and/or develop and test new products and features;
- update our Services application from time to time and monitor metrics such as total number of visitors, traffic, and demographic patterns;
We will not rent or sell your information to third parties outside Challenges, or its subsidiaries or affiliates without your consent, except as noted in this Policy.
3. Sharing Information
You own all of the content and information you post or create on our Services, and you can control how it is shared through your privacy and application settings. In addition:
- For content covered by intellectual property rights, like photos and videos (IP content), you specifically give us the permission to use any IP content that you post on or in connection with our Services under a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license.
- When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others);
- When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of our Services, to access and use that information, and to associate it with you (i.e., your name and profile picture);
- You understand that we may use your feedback or suggestions without any obligation to compensate you for them;
- You have an option to locate other persons through our Services through their usernames, or contacts list on your device;
- If you choose to find other persons through your device's contacts list, then We will access your contacts list to determine whether or not someone associated with your contact is using our Services;
4. Storing Information
Information collected through the Service may be stored and processed in the United States or any other country in which Challenges, its affiliates or service providers maintain storing/collecting facilities.
Challenges, its affiliates, or service providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.
By registering for and using the Service you consent to the transfer of information to the U.S. or to any other country in which Challenges, its affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.
Although we use reasonable safeguards to help keep the information collected through the Service secure and take reasonable steps to verify your identity before granting you access to your account, Challenges, its affiliates or service providers cannot ensure the security of any information you transmit to us or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.
Please remember that you are responsible for maintaining the secrecy of your password and account information, and for controlling access to emails between you and Challenges, its affiliates or service providers at all times.
5. Privacy of Children
OUR SERVICES AND THEIR CONTENTS ARE NOT DIRECTED AT CHILDREN UNDER THE AGE OF 13, AND CHALLENGES, DOES NOT KNOWINGLY COLLECT OR SOLICIT ANY INFORMATION FROM ANYONE UNDER THE AGE OF 13 OR KNOWINGLY ALLOW SUCH PERSONS TO REGISTER FOR THE SERVICE. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. 6. Third-party Services
Challenges is not responsible for the practices employed by any websites or services linked to or from our Service, including the information or content contained therein. Our Privacy Policy does not apply to those third-party websites or services when you use a link to go from our Service to another website or service. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party's own rules and policies.
7. Updates to this Privacy Policy
Please review this Privacy Policy periodically as Challenges may modify or update it from time to time. We may provide you additional forms of notice of modifications or updates as appropriate under the circumstances. Your continued use of the Service after any modification to this Privacy Policy will constitute your acceptance of such modification.
